Maritime Liability

The Commander is responsible for the safety of the vessel and the persons on board. All persons on board are subject to his authority. The special attention and burden to which the Commander is subject, leads him to greater responsibility in all the decisions he makes, during preparation, boarding, navigation and docking.
The activity of chartering, carried out with leisure boats, is subject to safety regulations contained in the Regulations of the Nautical Code (sections 78 to 89).
The principle followed in drafting this legislation was to create a set of safety rules distinct from those governing leisure boating for purely recreational and non-profit purposes, so as to generate a system that guarantees the suitability of vessels for chartering.
Law No. 990 of 24/12/1969, as amended and supplemented, concerns the mandatory liability arising from the circulation of motor vehicles and watercrafts. We fall under the general principle set off in Article 2043 of the Civil Code.
"Any intentional or negligent act that causes unfair damage to others shall oblige the person who committed the act to compensate for the damage".
